Who would you want to testify against you, a friendly or an enemy? Think of the concept Controlled Opposition before you answer. To me this only strengthens the bond and trust between Dr Bal and then Zimmer Biomet CEO David Dvorark. Thats something i indicated years ago when someone tried to imply that the relationship between Zimmer and Dr Bal soured after this testimony. All the while Dr Bal is working with Zimmer Biomet CEO David Dvorak, at that time, as a trustee for the Orthopedic Research and Education Foundation. Something that would likely strengthen their business relationship.

BTW, why was the information about Zimmer acquisition of Centerpulse withheld from the 2014 IPO paperwork but not the 2007 paperwork for information on the Chairman Dr Link? Why was the fact that Dr Bal, only a board member at the time, was a surgeon designer for Zimmer not included in the 2014 IPO paperwork the way it was included about Dr Hofmann on the 2007 IPO paperwork?

Point 1: Sintx CEO Dr Bal has been a paid consultant for Zimmer (surgeon designer from 2002 - 2014+)

Dr. Bal has been performing hip and knee replacements for the past twenty years and usually performs between 150 and 400 knee replacements each year. (Bal Rep. at 2; Bal Dep. 27:8-13.) In addition, he has acted as a paid consultant for hip and knee device manufacturers, including for Defendant, and has assisted in the design of implant components. (Bal Rep. at 2, 30.)


Point 2: Controlled Opposition is a method to control/neutralize information; in this case negative.

Preempt or neutralize true but negative information by having it be disclosed or championed in a skewed/stigmatized manner by a person or group. The truth can be peppered with disinformation or the truth of the message can be neutralized by association due to the extreme, radical, or unpalatable positions held by the controlled entity (person or group) who is disclosing the information or is “championing” a position. The stigmatized or adulterated truth in turn steers people away from truthful information which would normally cause criticism or a serious backlash against the controlling party.


Point 3: Zimmer Biomet CEO David Dvorak, in 2016 and Sintx CEO Dr Bal join OREF at the same time. Thus some hobnobbing would ensue for however long the two were on the board of trustees for...at least the entire period when that testimony took place.

Point 4: After Dr Bal and Mr Dvorak join OREF, a partnership between Zimmer Biomet and OREF began.

Extra information on the status of a Si3n4 based hip implant:

Silicon nitride, silicon carbide and diamond-like carbon as non-oxide ceramics are considered to be the new generation of materials used in hip prosthetics, particularly in the manufacture of acetabular cups, due to their excellent biocompatibility, osteointegration, and tribological and mechanical properties, but all three materials need more study. However, silicon nitride is the nearest to commercialization, through businesses such as Amedica Corp. and SyntX Technologies


Im guessing the authors meant Sintx Technologies. Amedica being the companies former name before the name was sold to CTL.
