Well if MTD is eventually denied , the discovery and trial process has to go through the usual length unless there is a settlement . If they had given the formula first time around it would have shortened it by few months . This has only prolonged the process. I would agree that judge has given them olive branch by giving another chance . I would assume that lot of other judges would have said - I gave you a chance to provide me what I asked and you still did it so that’s that and would have granted MTD
