I tend to agree with you. I've seen more than a few well versed attorneys that say this is right in the same line as most expedited judgments come in and what happened with the lower court is just procedural.

In layman's terms..... don't get your panties in a bunch. This is a big case and it's not the only one on their docket so they all need to be on the same page when they issue their decision. Wether it's up or down is up to them but it needs to be solid before they toss the ball into Alito's court.

The conservative bent SCOTUS might not want to touch this for obvious reasons but the SCONY have to make damn sure they are covered if they do...
