So help me understand this. Merck is investing 100's of millions in a new facility and personnel for something they may or may not have access to?

IMO, for Merck to dish out so much money there needs to be some sort of guarantee and thus if they have one with NWBO it would be material and had to be disclosed.

What I missing?

Honest question...I am just trying to understand your premise here.
