On termination of this agreement due to HYFI failure to comply with 3.1, ALL THE TERMS OF THIS AGREEMENT SHALL BE CONSIDERED NULL AND VOID

You claimed that the company's 30 business days had elapsed without an update therefore contract was terminated.

Someone politely showed you your computation on the 30 business days was in error IAW 8K filings.

(“Business Day” means any day other than a Saturday, Sunday or a gazetted Victorian Public Holiday;)

You then claimed that the corrected 30 business days had elapsed without an update.

Again someone politely showed you your computation on the 30 business days was in error IAW 8K filings.

(“Commencement Date” shall mean the date of this Agreement upon the condition’s precedent being met)

You continue to claim/harangue there is still no update and implying that they are not updating because they can't get the financing.

CONFIDENTIALITY

10.1. The PARTICIPANTS acknowledge that the provisions of this Agreement and the negotiations leading up to it are confidential between them and shall at all times during the term remain confidential.
