They do not provide adequate current information with quarterly and annual reports, but do submit information at least every six months (to the OTC markets data or the SEC’s EDGAR system). This category may include companies with accounting issues, or those in financial distress, or bankruptcy.”

Looks like the effective date doesn’t matter (the 60 day mark you are talking about), it just needs to be submitted or filed. So why would it go to EM?
