I also wonder if Amarin was forced to settle the lawsuit because of pressure from large insurance companies. The magistrate judge in Delaware, if I recall right, noted in her written opinion letting the lawsuit move forward that a pharmaceutical company suing an insurance company was a case of first impression. Insurance companies of all sizes did not want to see a precedent set with this lawsuit. So perhaps some of the big insurance companies either dropped Vascepa from their formularies or threatened to, thus putting pressure on Amarin to settle. Either way, it was clear that Amarin not only could not disclose the terms of the settlement but also wasn't allowed to boast about it in any way, except for a single sentence in the SEC filing. And then KM barely mentioned it after the next earnings announcement.
