Another federal court in the Southern District of New York just vacated a $744,783.67 judgement pursuant to F.R.C.P. 60(b)(1), entered in favor of #LGCapitalfundingLLC against #ExeledHoldingsInc. #EXEL in 2021 (case no. 1:17-cv-04006). The court was clearly persuaded by the New York Court of Appeals decision in Adar Bays, LLC v GeneSYS ID, Inc. wherein New York's highest court agreed with us, that a #convertiblenote #conversiondiscount is interest, subjecting the transaction to New York's usury statute.
