Spoofing is the subject of the case not the conspiracy theories put forward by short sellers. Northwest Biotherapeutics isn't vulnerable to discovery in any way since they're not on trial. Nothing Northwest Biotherapeutics did or could ever do would enable or justify Market Makers to engage in criminal behavior. If defendants algorithms are designed to spoof then their intellectual property could be asked for in discovery which explains why they will likely want to settle!
This is comical. Without splitting hairs, there are two parts of the lawsuit that NWBO needs to prove!
1) was there spoofing? I’ll concede there probably was!
2) DAMAGES!! Do you understand this? Seriously! Do you? LP and her team will need to PROVE that spoofing is THE cause for the share price and any damages. Questions about the runup will be asked! What caused that? SEC citing irregular accounting methods while Linda is CFO! Delayed trial results! No BLA submitted! Stock price hasn’t recovered since the lawsuit was filed and PR’s have been released. Hell, even the JA occurred! So unless you’re alleging that the spoofing is still occurring, how can one PROVE damages when the stock has gone backwards.
Tough hill to climb! Sorry, but I don’t see this being over for years! And yes, Linda’s incompetence will be a major defense of theirs as to why the stock price sucks!!
No institutional investors? No open market purchases by insiders? Laughing! No serious investor is buying this right now
