Good luck with that. His defense would be he was only offering an opinion (PFS should be the standard rather than OS) rather than fact. The court will rule in his favor as long as it's presented as an opinion. If this wasn't the case, there would be a number of lawsuits filed based on entries from some of the posters on this board.
