Read DOE 2022 Litigation Summary issued today which I posted. Same 17% of delinquent filings line item every year, year in, year out. Best they concentrate on the almost $7billion in fines and sanctions for civil and criminal cases instead of wasting money bullying start up companies out of business.

DBMM had mitigating circumstances and provided evidence proving same. If result is the same for being late, no matter, there would be no due process.

Judge Foelak understood the legal judicial discretion which allowed a Dismissal. The law is not black and white. The Commission has never intended that outcome. Judge Foelak knew.
