Yes, it is a strategy that I just learned about as well. We as lawyers are programmed at all levels of the courts, that waiver is a bad thing bordering on malpractice. I have consistently advised clients that the worst thing they can do is do nothing. At the Supreme Court, waiver is encouraged because there is apparently zero risk of the Court entering a summary reversal without first hearing from our adversaries.
