It’s absurd to say it failed on PFS knowing about pseudoprogression AND knowing that the presentation itself and the company long before unblinding, which he surely knew, had changed the endpoints. It’s a technicality, that he can claim ignorance or that he only relied on the database and did not believe or hear what the company had already told everyone. We know he has said for years that they could not change the endpoints, another false statement, but his claimed belief in that is a kind of defense, though arguably ignorance of the law is no defense and he insists with certainty he is right rather than giving all the facts. He should have told the whole story, but just the narrative he desperately wanted to tell. By doing so, and telling only the details he wants to tell, to save his reputation, he has engaged in the worst possible behavior. Consistently. Even when it is shown, as in the court opinion, that his opinions are frequently, flatly wrong.
