I'm sure they're weighing their options, the ruling was only a month ago. And this from your post on Wednesday:

Also, the J&J judge, Kaplan, made an interesting argument that I think the current Supreme Court may find compelling; plaintiffs are better served by some compensation today in lieu of a possible larger compensation years out. In regard to the Supreme Court, it's divided 6-3 so Roberts can side with the 'liberal' judges and it won't make a difference. When considering how this court might rule we should remember that it was the Roberts court that supported Citizens United 12 years ago. The court's sympathies lean more toward corporations today.
