The only area where I thought I might have been a little unfair to JT was the assumptions I made about the possibility that generics were open to any kind of a deal. I think JT made it clear after the Judge Du ruling that the generics were making extreme demands that would have been unacceptable to shareholders.

I think the judge might have been partially to blame here too for signaling to generics in various ways that she might rule in their favor. From court cases I've observed, judges often play a major role in steering both sides toward settlements. And purposefully so. Everybody ends up better off and disasters like this don't occur. Some judges are particularly skilled in this area. I think Judge Du has demonstrated that she is not.
