I believe that paragraph constitutes the "public notice of intent to merger" and has someone has posted the documents they filed with the sec i would say they can and probably are rebuying the float/buying in.

now also keep in mind that, per fan, his crew was issued over half the os as part of the take over from frank O and that frank O's shares then had been retired. which would leave less than 80b in the public float. and if they wanted to buy the whole float (they cant since some of us wont let go of our shares) they could do so for less than $4mill. Assuming they really do have 150million in funding over at cinemax its a small price to pay to get rid of most potential suits they would encounter if they just reverse split people out of ownership.
