Marjac, the absence of company support could very well cause the Judge to second guess himself, as he may wonder, "how on earth could both pathways being undertaken be so paradoxically different? Especially where the company with it's vast resources chooses a very risky path, while shareholders are left to fend for themselves, as they pursue the most reasonable, and easy to prove path.
