So suing in a state court in California may be quicker and more CONvenient for the real estate salesman, but it will have very little utility in obtaining a judgement that can be enforced on those entities and persons. It can be tried, butt it is unlikely to succeed.

BTW, state courts have no jurisdiction of patent cases, so the fact that the judge is a former Irell & Manella counsel that did IP work is of zero relevance as regards patent matters. To the extent such are involved in this California state court case.
