Rayo: "No one else can use it ... legally."
True, for the moment. But since the patents belong to Notre Dame, they can take away those exclusive rights. I'm sure there is a contract. But I also believe that the contract requires KBLB to pay Notre Dame what it owes.
Last I checked, KBLB was in arrears in paying off their debt to Notre Dame. When KBLB is in breach of their contract, Notre Dame is probably able to assign those exclusive rights elsewhere.
This is one of the reasons why KBLB should not claim those rights are 'OURS.' The patent was awarded to someone else.
I would be surprised if KBLB sent a 'cease and desist' letter to Entogenetics. They don't own the patents. The letter (if any) should have come from Notre Dame. However, Entogenetics was working with black widow spider silk genetics, while KBLB's is based on Golden Orb spiders. It isn't clear whether or not Entogenetics was infringing on the Notre Dame patents. It was clear that Entogenetics had pretty much failed on its own accord. Evidently they had difficulty in getting the spider silk genes to breed true generation over generation.
Sort of like the problems KBLB is having in Prodigy? Can't be sure, but their actions suggest a similar problem remains even today.
I'm glad they are looking into other applications of their technology. Randy Lewis found a way to hydrolyse silk into a goo a while back. Don't know if KBLB is licensing that technique or found something different.
But KBLB always seems to be going off in new research directions rather than focusing on their core business. Certainly it is possible to walk and chew gum at the same time, but KBLB is still trying to show they can walk. Chewing gum may be asking a bit too much at this particular moment.
