The argument is that shareholders were entitled to dividends when earnings exceeded the 10% dividend. This would have happened in several quarters during the period after the NWS was imposed.

The NWS also precludes payment of future dividends, essentially transferring those dividends to Treasury. This seems like a pretty direct injury.
