The only point that's relevant: Were there 45 to 50,000 deaths? That's it for banning the EUA. If the Whistleblower can show the documented evidence, there's not much of a defense. If they bring in the data person(s) from FDA and they confirm it, it's over. And since they have multiple whistleblowers, there's more evidence than needed, and that would corroborate their statements.
