You can’t successfully FOIA an active investigation, if one exists.

There are people who do this to create false impressions because the agencies will always say “we can’t confirm or deny” and it is often played on social media as meaning there must be an investigation. But that’s false.

And for a lawyer who knows what it means, it’s a total waste of time. The company can’t legitimately do anything with such a non-response response.
