I completely understand all the arguments and issues you have been raising for the past year here on this board.
They are all valid IMO.

It comes down to two things IMO:
(a) If the shareholders have legal counsel of record sitting at the table right now, they will overcome every obstacle you have raised and get Billy to negotiate a piece of the settlement pie.

(b)If there is no legal representation in place - if shareholders are just consulting with and discussing things with lawyers - then Billy will run this thing past everyone, get his money, and disappear.

I am told that "we can't tip our hand right now and say on this board whether or not we have retained counsel".

Not sure why that's the case if that counsel is on the record and in the public domain, but again, it's simply a question of whether or not shareholders' lawyers at at the table right now or not.

Everything else - all the arguments for the size, the basis of the settlement, the waterfall thing, Deidre ..... all insignificant if the shareholders have lawyers in the room.

If not, then pull the bread out, we're toast.
