No, he specifically said the drink would be a household name by April 1st.

Although he didn't give a specific timeline on when the drink would be in Kroger and 7-Eleven, if he made that statement without having an agreement in place it could mean trouble since the SEC would view a statement like that as an inducement to purchase the stock by making unsubstantiated claims.
