Dude...Did you notice there is an Appeal? This means it's part of their strategy. Can it be any more obvious? In other words, there was no conclusion made other than what is in the docket. Did I have access to counsel's plans? Nope.

It's not possible to be wrong when the litigation didn't reach the trial phase. That's what I mean by keeping context with my opinion posts.

I still maintain that Rontan would have prevailed at trial if they paid their counsel. The reason is they had a very strong Affirmative Defense.

Oh, and the Motion to Dismiss that was GRANTED is not subject to dispute since it's in the docket. Reference DE 49.

ORDERED AND ADJUDIED that:(1) Defendants' Motion to Dismiss is GRANTED.(2) Plaintiff's Complaint is DISMISSED WITHOUT PREJUDICE.(3)
