If Koh follows that previously demonstrated modis operandi, then she'll cancel the hearing (which she already did) and dismiss the case. And, therein is a little evidence for us of how Koh operates, right?

I was asking before if you've ever seen an instance where Koh cancelled a hearing prior to a scheduled date and then DIDN'T dismiss? I can't find evidence of that, which therein again offers more evidence of how Koh could act here.

I understand what's going on with the recent cases, apples/twitters pathetic attempts to distort the law in their favor. And, with Koh they may make some progress, but in this case I think Koh MUST know that these attempts by Apple/Twitter and co. are an absolute Hail Mary.

highly unlikely, but even if Koh does agree to take the case, then dismiss. No way in hell that flies in the appeals/mandamus court. It will prolong things and hit the PPS hard, but even then I think VP wins in the end and Koh end up with big mud on her face, which I don't think she wants.
