That is true, absolutely can be set aside. However, I don't expect it to be for the following reason. Had the defendants only claimed that they did not receive mail on time, there is a chance that the default judgment would be set aside. However, it is extremely clear based on the court filings that they played games in discovery, defined court orders, and abused the legal process. The judge knows that and that's not really in dispute. That is why I do not believe the default judgment will be set aside. How ever, I would not bet my life against it.
