here are the actual INDICATIONS:

Indicated as an adjunct to diet to reduce high triglyceride (TG) levels (ie, ≥500 mg/dL)
Cardiovascular risk reduction
Indicated as an adjunct to maximally tolerated statin therapy to reduce risk of myocardial infarction, stroke, coronary revascularization, and unstable angina requiring hospitalization in adults with elevated TG levels (≥150 mg/dL), AND
Established cardiovascular disease, OR
Diabetes mellitus and 2 or more additional risk factors for CV disease

The court bought the argument that there is a population with TG>500 that has risks of pancreatitis that does NOT have diabetes and 2 CV risk factors or TG>150 and etsablished CV disease. therefore, even though tehy are as you say at CHRONIC CV risk tehy are at acute/subacute pancreatitis risk and tehrefore fair game for a MARINE patent linited use...
