Yes, they seem to be. Right now, five or six similar--nearly identical--cases are in the works. The earliest was SEC v Ibrahim Almagarby, brought in 2017. About two weeks ago, the SEC won summary judgment in that one. So although the case isn't quite over, unless Almagarby appeals, it'll be finished soon. And then the rest of the toxic funders will have to come up with a new defense or find a different way to conduct their business.
Two other recent ones were SEC v Fierro and SEC v Keener.
