Like I said, nothing has been decided. The case will be decided on its merits. Unlikely the judge would spend time ruling on the motions from both sides if the court lacked jurisdiction. Judge will rule that the case will be decided on its merits and the court has jurisdiction. He already has declined this motion from defendants:
