Another way of thinking about it—a settlement of litigation at any stage demonstrates that a dispute that was brought to a court to resolve now no longer exists. There is then no case or controversy for the court to determine who is right or wrong. Courts do not decide cases that involve hypothetical questions or disputes. The original case or controversy is gone and has become moot.
