OVERVIEW
Cleve B. Tyler, PhD, is a managing director at Berkeley Research Group. For more than 20 years, he has applied economic analyses to intellectual property, competition, and damages issues in matters before federal and state courts, administrative law judges, and regulatory commissions, and in merger investigations. He has testified at deposition and trial in federal court and at arbitration. Dr. Tyler is an adjunct professor of economics in Johns Hopkins University’s applied economics program, teaching graduate-level courses in industrial organization and microeconomics over the last 10 years.

Dr. Tyler has developed or analyzed damages models for many types of claims, including patent infringement, trade secret misappropriation, copyright or trademark infringement, breach of contract, breach of fiduciary duty, fraud, antitrust, and unfair competition. His competition and antitrust work includes evaluation of market definition, market power, and competitive effects using regression analysis and economic modeling, and evaluation of both horizontal (e.g., merger as well as price fixing) and vertical (e.g., monopolization, attempted monopolization, and foreclosure) competition issues. Dr. Tyler has experience analyzing numerous industries, including waste collection and disposal, pharmaceuticals, medical devices, biologics and biosimilars, big data, semiconductors, cable modems, high-speed data services, electricity generation and distribution, enterprise software, online search advertising, video games, insurance, healthcare, avionics, automobiles and automobile components, home appliances, and food and beverages.

Dr. Tyler holds a PhD in economics specializing in industrial organization, finance, and the economics of the public sector. He has published papers on damages and competition issues, including in Antitrust, Antitrust Bulletin, and The Global Competition Review; and in a chapter on expert testimony admissibility in the book Calculating Intellectual Property Damages (annually since 2010). He previously taught economics classes at Clemson University. Dr. Tyler is the managing editor of the BRG Review and a member of the American Economic Association and American Bar Association.
