Yeah, it could be any one of a number of things why the 9th Circuit was selected.
In my mind they should have gone with NJ or DE where most of the drug patent trials are held.
In my way of thinking, Covington probably thought the case was in hand for a big win and maybe wanted Reno as a site so they could play the slot machines and craps tables in the evening. Believe me when I say I have seen stranger justifications.
IMHO the site selection was a grievous error that has cost us dearly.
