I don't think a reasonable settlement was ever on the table - because of FTC and anti pay to play laws, lets assume both sides knew regulators would reject a settlement involving any significant amount of money - even giving generics some % of net sales would not be allowed. So what does AMRN have left to offer? Early entry. If generics said "we want to sell GV in 2025 or no deal", what would you have done? No effing way do I agree to that - AMRN would have spent all the money building out the market (yeah, it's going to take that long to get near peak sales), and as soon as they start making real money the generics get to ride their coattails and steal the entire market - AMRN is in a lose-lose situation there, no choice but to go to court under the reasonable assumption that you'll get a law and order judge that follows the rules instead of one that goes out on a limb and creates who own laws, on top of one who clearly doesn't understand biostats.
