I don’t believe that’s the case... in all likelihood the appeals court would hold on accepting the appeal while Du reconsiders a motion based on rule 60. By filing the notice of appeal first it sets pressure for Du to review conclusions based on facts at hand...meanwhile the court of appeal is observing the speed of this process.
