Even though BP has "connections" I'm not sure how much of a "better result" they'd be able to get in the appeal trial if they were handling it instead of AMRN.

That's hardly the only consideration. Let's say AMRN appeals/controls things for another 2 or 3 years. How does the perpetual uncertainty help the stock price? Even after a win, the residual value of any exclusivity would be devalued accordingly - IF they won.
