Marjac ...I'm interested in how you would pursue the question of wether AMRN made a reasonable settlement offer pre trial .
So you file then request all settlement papers in discovery . I'm assuming the " settlement judge " had a recorder in the conference room .
What are you looking for ...that AMRN refused to make an offer to settle ...that they did but it wasn't sufficient ?

If you find that the generics refused all offers...as HDG has pointed out ...Dr Reddy has a history of refusing to settle these cases....do you then drop the case ...In that case what are Amarins remedies against you . Their legal costs , damage to reputation etc

Whats the downside for you if you file ...and find there's nothing there .

PS. Amarin has a history of being willing to make settlement offers ...the one they did with Teva for example
