In reading the judges ruling - she basically completely tossed water in the plaintiffs argument that there is a fundamental difference between severe HyperTG (>500) and just elevated TGs (<500). She essentially decided that this objective inertia prior to 2008 did not exist or at least there’s no evidence that it existed. She does not take the expert testimony or skepticism demonstrated in discussions of Marine before the trial because the individuals were hired by Amarin. This seems like quite a hole in judgement - question is can a subjective assessment like this be fought in appeal.
