Evidence? This is just my opinion based solely on who the Defendant in these cases are. The United States Government and Treasury. Know your audience. If you truly believe they are going to give back overpayments, then you don't know your audience.
PS If they did that would be tantamount to an admission. They don't even think what they did was wrong, let alone illegal. They will NEVER settle. They will NEVER return overpayments.
