That is not verifiable and as such is simply conjecture.
I’ve just cited SEC general policy that states petition for reviews are invariably granted and that petitions to oppose the review are seldom filed, because the SEC invariably denies the opposition petition. The participant even has to ask the board for PERMISSION to even FILE such a document!
People might as well come to the realization that this review will undoubtedly be granted.
And even if Fritz WANTED to file an opposition to the review, the Board probably wouldn’t accept it.
This will require both sides to resubmit their arguments to the board.
They will hear them and then decide whether or not to affirm or remand the initial decision.
