You are correct. Capacity and ability are two very different words and words mean everything to lawyers. What is interesting is the word "can" in the 2012 document which implies the then present tense ability for production at the levels being discussed. Capacity implies sufficent space while ability implies all limiting factors, like space, clean rooms, supplies and necessary personel for production are no longer an impediment. Best wishes.
