Nope, the crime is all that matters and the company cannot blame their transgressions on another party. Was covered in one of the earliest statements from the SEC.
Becoming current is restitution which was why it was so important to do it properly. So when the company did a shoddy job, attempted to blame everyone else including the judge, and waiting till several orders passed to finally do it properly was important. Instead they did nothing to endear themselves to the judge.
Any trial is ALWAYS about the transgression. The restitution can buy you brownie points but it doesnt make you not guilty. When the company discovered the flaw with the previous auditor they should have reported it and gone hands off. Instead they ignored orders to remedy the situation until they ended up in more trouble.
