Who will legally supply Apple with LM105, after li formally discontinues the formula from sales in 2020?
I believe Apple can get LM105 from anyone they want.
The MTA gives Apple perpetual and exclusive rights to LQMT technology in the field of CE. (Appendix 6, https://contracts.onecle.com/liquidmetal/apple-transaction-2010-08-05.shtml)
The MTA defines LQMT technology as the following:
“LMT Technology" shall mean any and all Intellectual Property and Intellectual Property Rights that, at any time during the Capture Period, are: (a) owned or licensed (including, without limitation, sub-licensed) by LMT or LMC, or that LMT or LMC have a right to use...
(MTA, section 1(a)(i).)
Assuming that LM105 was owned or licensed by LQMT, or that LQMT had right to use it, at the time of the MTA, then Apple got a license to LM105 when the MTA was entered into.
I would be shocked if Apple had taken a perpetual license without also securing a license for all necessary materials to practice the licensed technology.
Mr. Li said "You need to believe me. I am not a Story Teller, I am really a Just Do It person" who hasn't done anything for LQMT's share price.
