By the way, is shorting against the box from 44 down to 9 cents legal in Hong Kong? How do we know that Li has been "losing" money on his investment?
I don't know for a fact (i.e., cannot point to a particular statute), but I'm willing to bet that insider trading for companies inside of the U.S., or traded on U.S. markets, is illegal in the U.S. regardless of where the trade occurred. If not, that is one hell of a big loop hole.
I'm also very confident that the SEC regards shorting as trading.
Now, I've been greatly concerned about Li's conflicts of interest, but so far I've believed that he is too smart to engage in outright illegal behavior such as insider trading.
What is your opinion?
