I have never been certified as an expert witness but have been used in two cases that were specific to my area of expertise. If I had ever made a statement such that said the other side had made over reaching claims that bordered on being deliterious to the public interest without even specifying what the claim was, well you know what would happen in a courtroom.

If the AMEX claims can not be released with specifics you can't prove that their list related at all to the Class action suit. They really are nonspecific inflamatory rhetoric and would be found prejudicial to the defense without having any bearing on the case. It is interesting that the AMEX would seem to be doing all intheir power to do exactly that and for the life of me I can't figure out why they would do this while a class action suit is progressing therough the courts. Can you tell me why this form wasn't filed immediately after GTE indicated that they had no interest in paying for another go around of AMEX justice? The timing of the filing is specious to me, but maybe you may have the answer.
