Highly doubt we have any chance of complete loss in this case. The defendants have already expressed they are looking for valuations on the patents in reference to valuations received by Chanbond. If they are looking for valuations obviously they are preparing for the event of a settlement on fair value. They are now having their expert witnesses expound on the valuation subject. With that being said they are trying their hardest to low-ball the value of the patents based on third party valuations. If that isn't damn near admitting defeat due to having a very weak argument and case - then i'm not quite sure what is.
FACT: MSOs requested information regarding third-party valuations quite awhile back - now they are using their expert testimonies to argue the value of the patents.
Seems to me they are in agreeance they cannot win this case and are now just looking to get the value down as much as possible in the eyes of the Court
