Yeah I agree, that's why he even pressed our legal team as to why we are giving them a marble to use to delay trial (Cisco appeal). This has been going on for years and we are at the home stretch this year. There is nothing left - Arris is now crying to the Federal circuit referencing cases in the Supreme Court that are not even comparable to their situation, RPX is whining to the Supreme court but they won't even look at their cries. Cisco is the last straw - the 13 need these claims to hold up in order to have ANYTHING going to trial (more likely settlement table). If they lose these claims they have literally zero arguing points going to trial, and zero leverage at the settlement table. If their claims hold up and we get denied then they have some arguing points to talk Billy down some at the settlement table and feel good about not getting squashed for what could have been much bigger - ultimately coming to an agreement as Billy will take a little less just because of inherent risk factors.
