RPX appealed to the SC when their appeal at CFAC was dismissed. Arris's appeal that was just dismissed was at the CFAC. Arris sent a letter to the judge a few weeks ago citing a case that was appealed to the SC and heard because the lower court didn't take into consideration the monetary damages to the petitioner before dismissing the case.

If RPX and Arris cases were heard and lost in the court of appeals, they would have no further recourse.
