The message board covered this years ago. The advantage folks like phase v and af have is they can allege failure or uncategorically state trial failure, and if they were wrong, the company cannot go after them during the trial because it would create a discovery dig for trial statistics. You can’t go after them if AF was wrong until after the trial is unblinded imho.
