Nice try...The first Amendment is not restricted to doctors...This settlement pertains to commercial aspects of the First Amendment and applies to the court's stand on whether FDA can legally prevent Amarin (in this case) from disclosing truthful and non misleading information about its drug...FDA can not...And this is not limited to doctors...Also the decision is not solely about R-I...But truthfull and non misleading information in general...

Also unless a patient is a licensed physician with a DEA number he can not prescribe or even buy the drug legally without a script...
